GIVEAWAY PERIOD: The Trupanion Pet Scale Giveaway (the “Giveaway”) begins on December 12, 2024 at 12:01 AM (Pacific time) and continues until February 28, 2025 at 5:00 PM (Pacific time), only while supplies last (the “Giveaway Period”).

ELIGIBILITY: To be eligible to participate in the Giveaway, you must be a veterinary hospital that (i) received an invitation from Trupanion to apply to receive a gift pursuant to these rules, (ii) is located in the United States, and (iii) does not currently license Trupanion’s Vet Portal software. Eligible participants who, during the Giveaway Period, (1) contact Trupanion and install the Trupanion Vet Portal software, (2) have at least one full-time employee take and complete a free online course offered by Trupanion with six lessons about the Trupanion Vet Portal software and become “Trupanion Certified,” and (3) complete the sign-up process for Trupanion’s “Hospital Certification” are eligible to receive a free Mella pet scale or, in Sponsor’s discretion, the cash equivalent. Current Trupanion Vet Portal software licensees and users are not eligible. Employees of Trupanion Inc., and its affiliates, subsidiaries, representatives, advertising, promotion and publicity agencies (“Sponsor”) and the immediate family members and persons living in the same household of each are not eligible. Invitations to participate in the Giveaway are non-transferable. Void where prohibited, restricted or taxed by law.

GIFT: Each eligible participant who completes the eligibility requirements (i.e. installing the Trupanion Vet Portal software and having an employee complete the Trupanion online certification course, all during the Giveaway Period) will receive a free Mella Biggie Pro Body Scale pet scale (approximate retail value (ARV) $350) or, in Sponsor’s discretion, the cash equivalent. Gift will be awarded to participating veterinary hospital. No substitution of gift for cash or other goods and services is permitted, except Sponsor reserves the right to provide a substitute gift of approximately equal or greater value. All expenses not specified above, including, without limitation, all federal, state, and local taxes, are the sole responsibility of the gift recipient. Gifts may be mailed, shipped, or otherwise delivered to gift recipient, at Sponsor’s sole discretion. Limit one gift per veterinary hospital.

HOW TO GET A FREE SCALE (or cash equivalent): To receive a free Mella pet scale (or, at Sponsor’s discretion, cash equivalent) during the Giveaway Period you must (i) contact Trupanion by submitting your contact details through the form on vet.trupanion.com/mella-giveaway-2024; (ii) install the Trupanion Vet Portal software on the computers at your veterinary hospital; (iii) have at least one-full time employee take and complete the online course offered by Trupanion about the Vet Portal software and become “Trupanion certified”. Information about the Trupanion Vet Portal certification program is available here: https://vet.trupanion.com/trucertification/. Standard terms and conditions apply to Trupanion Vet Portal software and online courses. Offer valid only while supplies last. Sponsor is not responsible for failed, inaccurate, incomplete, late, misdirected, or delayed communications. Individuals who participate on behalf of a veterinary hospital have the sole responsibility to review and understand the veterinary hospital’s policies regarding employee eligibility to participate in the Giveaway. Individuals who participate in the Giveaway on behalf of a veterinary hospital must have authority to participate on behalf of the veterinary hospital and to bind the veterinary hospital with respect to the Giveaway and these terms. Sponsor disclaims any and all liability or responsibility for disputes arising between an employee and his or her employer related to this Giveaway.

GOVERNING LAW: These terms shall be governed by the laws of the state of Washington, without giving effect to its conflict of laws rules. The courts of the state of Washington shall have exclusive jurisdiction over any dispute arising out of or in connection with these terms.

PUBLICITY AND ENTRANT INFORMATION: Veterinary hospitals participating in the Giveaway consent to the use of their name and logo (collectively, “Name”) for any publicity carried out by the Sponsor, without further notice or compensation, except where prohibited. Each participant understands and agrees that such participant’s Name may be publicly displayed, and that it will not be treated in confidence and each participant hereby provides Sponsor and its affiliates with the unlimited, worldwide right to use and share the Name (except where prohibited) (i) on its websites; (ii) in all of its social media channels, such as Facebook, Twitter, Instagram and Pinterest, including in both organic posts and paid ads; (iii) digital ads, (iv) emails; and (v) other promotional materials of any kind or type, including print materials.

GENERAL CONDITIONS: Free pet scales (or cash equivalent) are in Sponsor’s sole discretion. No substitution of a gift is permitted. The pet scale is provided “AS IS.” Sponsor does not make or offer any warranty or guarantee, either express or implied in connection with this Giveaway or the gift.

This Giveaway is void where prohibited, and subject to all applicable federal, state, and local laws and regulations. Employees of Sponsor are not eligible to participate. All federal, provincial, state and local laws and regulations apply.

Except where prohibited by law, as a condition of participating in this Giveaway, each participant agrees that any and all disputes and causes of action arising out of or connected with this Giveaway shall be resolved individually, without resort to any form of class action. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EACH ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

By participating, participants agree to be bound by these terms and conditions and the decisions of Sponsor which are final and binding, and that Sponsor, and their parent companies, affiliates, subsidiaries, divisions, and advertising and promotion agencies, and their respective officers, directors, shareholders, and employees (collectively “Releasees”) are not responsible for and will not be liable for losses or injuries of any kind resulting from or in connection with participation in this Giveaway, or the acceptance/possession/use and/or misuse of a gift.

Sponsor, in its sole discretion, reserves the right to disqualify any person who tampers with the process or the operation of the Giveaway, or who violates these rules, or who is suspected of doing so. If for any reason the Giveaway is not capable of being executed as planned due to pandemic, measures of any governmental authority, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Sponsor that affect the administration, security, integrity or proper conduct of this Giveaway, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Giveaway.

If any provision(s) of these Terms and Conditions are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
